All rentals are subject to the following terms and conditions. Please review thoroughly
before placing your order, or call if you have any questions. “We” or
“us” means www.lowergear.com,
and/or its corporate parent; “you” or “your” refers to the
renter.
START DATE
The desired starting date submitted with your rental order should be the latest
date you need the unit to depart on your trip. Under our standard shipping arrangements,
we try to get the unit to you at least one day before your start date. Due to very
limited weekend delivery options, the effective “Start Date” for your
rental must fall on a weekday. If you need unit for a weekend departure, use the
preceding Friday as your Start Date.
DROP-OFF DATE
The date the unit must be re-boxed and dropped off for shipment to any UPS office
or authorized center such as a UPS Store.
RENTAL LENGTH
The number of full or partial days between your Start Date and ending Drop-Off Date.
LATE CHARGES
If you do not deliver the unit for return shipment by your required Dropoff Date,
late fees in the form of continuing rental fees will be assessed at the daily rate
for rentals of less than one week.
DEPOSITS
To help protect us against loss, damages or theft of the unit, we require a deposit.
This amount will not be charged, but will be reserved against your credit card limit
as a pre-authorization. It will be released upon return of the unit in the same
condition as when delivered, normal wear and tear excepted. Any charges or reimbursement
costs due us beyond the deposit amount will also be charged to your credit card.
DAMAGES
Our rental rate assumes a limited amount of wear that may occur with a rental use.
However, broken screens, substantial scratches and body damage or missing parts
noted upon return will result in charges against your deposit for repair or replacement.
LOSS/THEFT/NON-RETURN
You are responsible for the unit at all times between delivery and return to our
facility. We provide no insurance against loss once delivered to your address.
SHIPPING
Shipping is based on low-cost options from our facility in Arizona to your designated
point of delivery, and then the return to our facility. We prepay the to/from shipping,
and the cost is included in the total that will be charged to your credit card.
A prepaid return shipping label will be in the box with the unit delivered to you.
You may use the same box to pack and return the unit to us. After repackaging the
unit, simply re-seal the box, affix the label, and drop off at an authorized UPS
shipping facility. Any refused deliveries will be processed as a completed rental
transaction, with the full rental fees assessed to the renter. Every effort is made
to deliver the unit to your designated address not later than the day before your
Start Date. Occasionally there are weather delays, or UPS delays delivery. We try
to find a solution if that happens, but our liability is limited to the prorated
rent related to the delay. Special provisions govern expedited shipping done at
your request; ask us for details.
SALES/USE TAXES
Units shipped to Arizona addresses, or as required elsewhere, may be subject to
applicable transaction (sales) taxes that will be added to the rental fee.
LIABILITY
You recognize and acknowledge that activities such as walking and driving can be
inherently dangerous and unpredictable. We are not responsible for any accidents
that may arise from your activity or use of our unit, and you hereby agree to indemnify
us from any claims, charges or costs arising from your use of our unit or any related
activities. While we will provide you a unit as described in our product descriptions,
we do not expressly or otherwise guarantee or warrant the unit for any specific
performance or purpose other than as it is described. If any item of unit malfunctions
or otherwise fails to perform its described functions, our maximum liability to
you is the rental value paid for the item.
RESERVATION REQUIREMENTS
Delivery via ground shipment typically requires 1 to 5 business days from the ship
date, depending on your distance from Arizona. Your order should be placed as far
in advance of your Start Date as possible to ensure availability and best selection
of unit. At certain times, inventory may not be available for your desired Start
Date. You will be contacted if your Order cannot be accepted due to prior inventory
commitments or other reasons. Alternative products or dates can be discussed with
you at that time. Rush shipments are available at additional shipping costs as charged
by UPS; contact us for special requirements.
CANCELLATIONS
If you cancel your order in writing more than two weeks ahead of the scheduled shipping
date, no fees will be charged. If less than one week, but prior to the day of shipment,
a $10.00 processing fee may be charged to your card. Additional financial commitments
may be required for large orders or orders for which we make special inventory arrangements;
you will be notified in advance if we deem such commitments appropriate. Cancellation
of an order is not an option once the unit has left our facility.
VENUE
Any judicial actions arising from our rental of unit to you will be held in the
appropriate court in Maricopa County, Arizona.
